Kazakhstan Mineral Extraction Tax update
A Kazakhstan tax-authority explanation of changes effective 1 January 2026 records a 0.1 reducing coefficient for Mineral Extraction Tax on solid minerals extracted from technogenic mineral formations, alongside a stated five-year MET exemption framework for certain capital-intensive mining projects. Together, they provide a timely basis for focused market planning.
Verified facts
- The tax-authority notice states that Article 783 of the new Tax Code applies a 0.1 reducing coefficient to the Mineral Extraction Tax rates in Article 781 for solid minerals extracted from technogenic mineral formations. The notice also says the preceding Tax Code did not have a separate article or calculation procedure for those solid minerals. A published tax explanation does not classify a particular stockpile, residue, formation, mineral, processor or taxpayer.
- The same notice describes a five-year MET exemption for existing capital-intensive mining projects under Article 782 where stated conditions are met, including production starting after 31 December 2022, an IRR of 15% or less and restrictions on transfer of the relevant subsoil-use right during application of the provision. Those published conditions do not prove that any project meets them, that the methodology has been applied, that the exemption has been granted or that its value has been modelled correctly.
- The Department of Geology separately reported an August 2026 programme update that opened additional territory for solid-mineral exploration. A programme-level availability statement is distinct from a tax treatment and does not establish the legal status, application route, geology, environmental boundary, licence decision, commercial viability or processing plan for a named block.
- World Bank mining-sector diagnostic material provides independent context on governance and development questions in Kazakhstan’s mining sector. It does not resolve an operator’s fiscal position, ownership, ore characteristics, reserves, recovery, environmental condition, licence, offtake, buyer, financing or transaction risk.
Horizon view
The practical research implication is a two-track test: first establish the physical and legal character of the material and the accountable right-holder; then model the applicable fiscal treatment against the consolidated current law and project evidence. The tax update can make legacy-material and processing questions worth screening, but it cannot turn a residue, licence map or policy statement into a bankable processing or supply opportunity.
Commercial implication and next step
For an authorised Kazakhstan materials or mining assessment, create a controlled fiscal-and-asset file: exact material and provenance; laboratory, volume, grade, recovery and waste/formation evidence; named site, subsoil/right holder, corporate ownership and authority; current licence, land, E&S, water, power and community conditions; applicable Tax Code text, tax-period, taxpayer and written specialist interpretation; full capex/opex, IRR and transfer-condition model where relevant; technology/process, permits, transport, product classification and export controls; named buyer/offtake and quality acceptance; insurance, price, currency, invoice, tax, payment security and collection controls. Do not quote a tax benefit, present a project return, approach counterparties as eligible or commit capital/equipment before these gates are documented.
What to verify before acting
The sources do not establish a technogenic mineral formation, a tax calculation, eligibility, exemption, mineral title, exploration or extraction licence, resource/reserve, geology, recovery, environmental permit, operator authority, funding, buyer, offtake, price, payment, contract or transaction. This is not Kazakhstan tax, mining, subsoil, environmental, investment, accounting, finance, insurance or legal advice.
